Do you need to comply?

An employer who has not entered into a workplace agreement (either a collective agreement or Australian Workplace Agreement) post 27 March 2006 or an enterprise agreement entered into post 1 July 2009 needs to provide the minimum terms and conditions outlined in a relevant award.

Conditions of compliance

Victorian independent schools, in operation prior to 27 March 2006, are either direct respondents to these awards or respondent by virtue of the award having been declared a common rule award.

The awards specific to Victorian independent schools are:

  • Victorian Independent Schools - Teachers - Award 1998
  • Victorian Independent Schools - School Assistants - Award 1998
  • Victorian Independent Schools - Clerical/Administrative Employees - Award 2004
  • Victorian Independent Schools - Early Childhood Teachers - Award 2004
  • Victorian Independent Schools - Nurses - Award 2003

If you have to comply, what do you have to do?

An employer must ensure that it is complying with the minimum standards contained in any relevant award, unless an employer has a collective agreement or Australian Workplace Agreement covering an employee's employment that was made post 27 March 2006 or enterprise agreement made after 1 July 2009.

Currently, wage and salary rates do not form part of an award (even if the rates may still be physically in an award). Minimum wages for employees covered by federal awards have been moved into documents called the Australian Pay and Classification Scales (the 'APCS'). The latest wage increases took effect from the first pay period commencing on or after 1 October 2008. The Australian Industrial Relations Commission (AIRC) is currently undertaking a process of award modernisation which will result in significant change in the area of award safety net regulation.
